90% Reservation for SSC is Discrminatory Under the Constitution

As per the educational Institutions the unfair and discriminatory reservation policy proposed by the Maharashtra state government to reserve 90% percent seats to SSC students in junior college.Under the constituion this proposal is discriminatory and violates the right of equality. There can be no reservation based on caste, race, religion when it comes to education.

Some Principals fear that this reservation policy might go against merit. For example, College AB closes 10% percent quota for Non-SSC board students at 91% , then students of ICSE, CBSE who scores below the 91% cutoff will be turned down. But the SSC students who scores 86% will be considered as per the reservation policy proposed.

Principals of some colleges question the very motive of the reservation policy. Seats have to set aside for minorities, economically weak and physically challenged students and not have a quota set aside for SSC students in general.

According to advocate Madhav Jamdar, last year the reason given behind the introduction percentile system to help SSC students was turned down by the high court. Thestate had reasoned that ICSE and CBSE give high scores to their students, on account of which the SSC students are ata loss. This logic was not accepted by the High Court. This time the same reason is being used by the state for introducing the 90:10 percent reservation policy. The lawyers are convinced that it will be hard to convince the high court to allow to implement the 90:10 percent quota.

According to Naresh Chandra, principal of Birla College, and Sanjay Kumar (TOI), said that the state has not revealed much details on how this quota will be implemented. The College principals forsee chaotic and more action admission season this year just like the one last year , if this proposal is implemented.
